प्रसह्य दिवा रात्रौ वा स शस्त्रस्य अपहरतश् चतुर् भाग मूल्येषु एत एव द्वि गुणा दण्डाः ॥

When any person with weapons in hand seizes by force, whether during the day or night, articles of ¼th of the above values, he shall be punished with the same fines.

english translation

prasahya divA rAtrau vA sa zastrasya apaharataz catur bhAga mUlyeSu eta eva dvi guNA daNDAH ॥

कुटुंबिक अध्यक्ष मुख्य स्वामिनां कूट शासन मुद्रा कर्मसु पूर्व मध्य उत्तम वधा दण्डाः, यथा अपराधं वा ॥

When a master of a household (kutumbádhyaksha,) a superintendent, or an independent officer (mukhyaswámi) issues or makes use of unauthorised orders or seals, he shall be punished with the first, middlemost, or highest amercement, or he may be condemned to death, or punished in any other way in proportion to the gravity of his crime.

kuTuMbika adhyakSa mukhya svAminAM kUTa zAsana mudrA karmasu pUrva madhya uttama vadhA daNDAH, yathA aparAdhaM vA ॥

धर्मस्थश् चेद् विवदमानं पुरुषं तर्जयति भर्त्सयत्य् अपसारयत्य् अभिग्रसते वा पूर्वम् अस्मै साहस दण्डं कुर्यात्, वाक् पारुष्ये द्वि गुणम् ॥

When a judge threatens, browbeats, sends out, or unjustly silences any one of the disputants in his court, he shall first of all be punished with the first amercement.

dharmasthaz ced vivadamAnaM puruSaM tarjayati bhartsayaty apasArayaty abhigrasate vA pUrvam asmai sAhasa daNDaM kuryAt, vAk pAruSye dvi guNam ॥

पृच्छ्यं न पृच्छति, अपृच्छ्यं पृच्छति, पृष्ट्वा वा विसृजति, शिक्षयति, स्मारयति, पूर्वं ददाति वा, इति मध्यमम् अस्मै साहस दण्डं कुर्यात् ॥

If he defames or abuses any one of them, the punishment shall be doubled. If he does not ask what ought to be asked, or asks what ought not to be asked, or leaves out what he himself has asked, or teaches, reminds, or provides any one with previous statement, he shall be punished with the middle-most amercement.

pRcchyaM na pRcchati, apRcchyaM pRcchati, pRSTvA vA visRjati, zikSayati, smArayati, pUrvaM dadAti vA, iti madhyamam asmai sAhasa daNDaM kuryAt ॥

देयं देशं न पृच्छति, अदेयं देशं पृच्छति, कार्यम् अदेशेन अतिवाहयति, छलेन अतिहरति, काल हरणेन श्रान्तम् अपवाहयति, मार्ग आपन्नं वाक्यम् उत्क्रमयति, मति साहाय्यं साक्षिभ्यो ददाति, तारित अनुशिष्टं कार्यं पुनर् अपि गृह्णाति, उत्तमम् अस्मै साहस दण्डं कुर्यात् ॥

When a judge does not inquire into necessary circumstances, inquires into unnecessary circumstances, (desa), makes unnecessary delay in discharging his duty, postpones work with spite, causes parties to leave the court by tiring them with delay, evades or causes to evade statements that lead to the settlement of a case, helps witnesses giving them clues, or resumes cases already settled or disposed of, he shall be punished with the highest amercement.
