त्रि पक्षाद् ऊर्ध्वम् अप्रतिब्रुवतः परा उक्त दण्डं कृत्वा यान्य् अस्य द्रव्याणि स्युस् ततो अभियोक्तारं प्रतिपादयेद्, अन्यत्र वृत्त्य् उपकरणेभ्यः ॥
If he does not answer even after three fortnights, he shall be fined for parokta, and the plaintiff shall recover out of the defendant's property the amount of the case. But if the plaintiff sues for a mere return of gratitude (pratyupakarana), then no (decree shall be passed).
english translation
tri pakSAd Urdhvam apratibruvataH parA ukta daNDaM kRtvA yAny asya dravyANi syus tato abhiyoktAraM pratipAdayed, anyatra vRtty upakaraNebhyaH ॥
hk transliteration by Sanscriptतद् एव निष्पततो अभियुक्तस्य कुर्यात् ॥
The same punishment shall be meted out to such of the defendants as fail in their defence.
english translation
tad eva niSpatato abhiyuktasya kuryAt ॥
hk transliteration by Sanscriptअभियोक्तुर् निष्पात सम कालः परा उक्त भावः ॥
If the plaintiff fails to prove his case, he shall (also) be guilty of parokta.
english translation
abhiyoktur niSpAta sama kAlaH parA ukta bhAvaH ॥
hk transliteration by Sanscriptप्रेतस्य व्यसनिनो वा साक्षि वचनम् असारम् ॥
If he fails to substantiate his case against a dead or diseased defendant,

pretasya vyasanino vA sAkSi vacanam asAram ॥
hk transliteration by Sanscriptअभियोक्ता दण्डं दत्त्वा कर्म कारयेत् ॥
he shall pay a fine and perform the (funeral) ceremonies of the defendant.
