"यः साहसं "प्रतिपत्ता" इति कारयति स द्वि गुणं दद्यात् ॥

He who causes another to commit sáhasa after the plans prepared by himself shall be fined twice the value (of the person or property seized).

english translation

"यावद्द् हिरण्यम् उपयोक्ष्यते तावद् दास्यामि" इति स चतुर् गुणं दण्डं दद्यात् ॥

An abettor who employs a hireling to comit sáhasa by promising „I shall pay thee as much gold as thou makest use of,‟ shall be fined four times the value.

english translation

"yAvadd hiraNyam upayokSyate tAvad dAsyAmi" iti sa catur guNaM daNDaM dadyAt ॥

यः "एतावद्द् हिरण्यं दास्यामि" इति प्रमाणम् उद्दिश्य कारयति स यथा उक्तं हिरण्यं दण्डं च दद्यात्" इति बार्हस्पत्याः ॥

The school of Brihaspati are of opinion that if with the promise „I will pay thee this amount of gold,‟ an abettor causes another to commit sáhasa, the former shall be compelled to pay the promised amount of gold and a fine.

english translation

yaH "etAvadd hiraNyaM dAsyAmi" iti pramANam uddizya kArayati sa yathA uktaM hiraNyaM daNDaM ca dadyAt" iti bArhaspatyAH ॥

स चेत् कोपं मदं मोहं वा अपदिशेद् यथा उक्तवद् दण्डम् एनं कुर्याद् इति कौटिल्यः ॥

But Kautilya holds that if an abettor extenuates his crime by pleading anger, intoxication or loss of sense (moham), he shall be punished as described above.

sa cet kopaM madaM mohaM vA apadized yathA uktavad daNDam enaM kuryAd iti kauTilyaH ॥

दण्ड कर्मसु सर्वेषु रूपम् अष्ट पणं शतम् । शतात् परेषु व्याजीं च विद्यात् पञ्च पणं शतम् ॥

In all kinds of fines below a hundred panas, the king shall take in addition to the fine 8 per cent more as rúpa and in fines above hundred, five per cent more.

english translation

daNDa karmasu sarveSu rUpam aSTa paNaM zatam । zatAt pareSu vyAjIM ca vidyAt paJca paNaM zatam ॥
